Hukuncin haya a cikin Musulunci
Haya halal ne a cikin Musulunci, kuma haƙiƙa Littafin Allah mai girma da sunnan Annabi mai daraja da ijma'in malamai sunyi nuni a bisa hakan. kuma yarjejeniya ce wanda ya wajaba akan kowana ɓangare da ya lizimce ta idan aka ƙulla ta, kuma za a iya ƙulla ta da duk wani lafazin da yake nuni zuwa gare ta; kaman na baka haya, da ɗauki hayarka da sauransu na abunda aka saba dashi a al'ada.
Daga cikin dalilan halaccin haya
Allah Maɗaukakin Sarki Yace:(Ya babana ka ɗauke shi haya, domin lalle mafi alherin wanda zaka ɗauka haya shi ne mai ƙarfi amintacce) (Alƙasas: 26).

Kuma shi ne manufar ƙulla yarjejeniyar; Sawa'an ya kasance amfanin ɗan Adam ne ko na dabba ko na wani abu na daban. a taƙaice shi ne abunda aka ƙulla yarjejeniya akanshi.
Shi ne abunda za a baiwa wanda yayi aiki ko ya amfanar sakamakon aikinshi, kuma shi ne kaman kuɗi ko farashi a babin saya da sayarwa.

Lokacin da haya take wajaba
Ijarah ko haya tana wajaba ne da yarjejeniya, kuma ya wajaba a dawar da wannan abun hayan bayan ƙarewan lokacin hayar.

Daga Abu Hurairah Allah Ya kara mishi yarda, daga Annabi tsira da amincin Allah su tabbata a gare shi yace: «Allah Ta'ala Yace: Mutane uku da Ni zasuyi husuma a ranar Alkiyama: Mutumin da aka ba shi domin Ni sai yayi yaudara, da mutumin da ya sayar da Ɗa yaci kuɗinshi, da mutumin da ya ɗauki hayan wani ya kammala mishi aikinshi sa'annan ya hana shk haƙƙinshi» (Bukhari: 2227).
